Digital Dolphins

1. Acceptance of Terms
By purchasing, accessing, and/or participating in any Digital Dolphins courses, memberships, community spaces, coaching sessions, events, resources, or AI-assisted tools (collectively referred to as the “Services” or “Program”), you agree to be bound by these Terms and Conditions (the “Terms”).
These Terms apply to all users of the Digital Dolphins website, platforms, and services. If you do not agree to these Terms, you must not purchase or access the Services.
2. Definitions

“Company”, “we”, “us”, “our” refers to Bettina Pfaendner, sole trader, ABN 56 586 379 618.

“Client”, “you”, “your” refers to any purchaser, participant, or user of the Services.

“Services” / “Program” refers to all Digital Dolphins offerings, including courses, memberships, coaching, community access, digital resources, and AI-assisted learning tools.

“AI Tools” refers to any artificial intelligence–powered tools, assistants, prompts, bots, workflows, or third‑party AI systems integrated into or recommended within the Program.
3. Scope of Services
The Services may include, but are not limited to:

Live and recorded courses, workshops, and training programs

Membership-based creative and learning communities

Group and individual coaching or mentoring sessions

Digital educational resources (videos, audio, workbooks, templates, prompts)

AI-assisted learning, creative, and reflective tools

Community discussion spaces hosted on third-party platforms
Access to the Services is limited to the duration of your active enrollment or membership. No compensation or refunds are provided for non-use of Services.
The Company may modify, update, or discontinue any part of the Services at its discretion.
4. AI-Assisted Tools and Use
AI Tools are provided for educational, creative, and exploratory purposes only.
You acknowledge and agree that:

AI-generated outputs may be inaccurate, incomplete, biased, or inappropriate

AI Tools do not replace human judgment or professional advice

You are solely responsible for reviewing, validating, and deciding how to use any AI-generated content
The Company does not guarantee the availability, accuracy, reliability, or continuity of any AI Tools or third-party AI platforms.
5. Client Responsibilities
You agree to:

Provide accurate and complete information when required

Maintain the confidentiality of your login credentials

Participate respectfully in community spaces

Use the Services for lawful purposes only
Your results depend on your participation, effort, and independent implementation of the materials. The Company is not responsible for your outcomes.
6. Fees, Payments, and Billing
You agree to pay all applicable fees as displayed at the time of purchase.
If a payment fails, you remain responsible for all outstanding amounts. The Company may suspend or terminate access to the Services until payment is received.
Late payments may incur a penalty fee of ten percent (10%) of the overdue amount.
You agree not to initiate chargebacks without first contacting the Company. You are responsible for any fees associated with chargebacks or collections.
7. Cancellation and Refunds
Unless otherwise stated at the time of purchase:

You may cancel within fourteen (14) days of purchase for a full refund

After this period, fees are non-refundable
Refund eligibility may vary for limited offers, events, or digital products and will be clearly stated where applicable.
8. No Guarantees
The Company makes no guarantees regarding outcomes, results, income, audience growth, creative success, or personal or professional impact.
All examples, testimonials, and statements are illustrative only and do not constitute promises of results.
9. No Professional Advice
The Services do not constitute legal, financial, medical, psychological, or other regulated professional advice.
Participation in the Program does not create an attorney-client, therapist-client, or advisory relationship.
You are responsible for seeking independent professional advice where appropriate.
10. Confidentiality
Client Information
The Company will treat client information shared in the course of delivering the Services as confidential, except where disclosure is required by law or permitted by you.
Participant Information
You agree to keep confidential any information shared by other participants in community spaces, live sessions, or forums.
Company Information
All proprietary materials, methods, and non-public information shared by the Company are confidential and must not be disclosed or misused.
11. Intellectual Property
All content provided as part of the Services, including course materials, frameworks, methodologies, prompts, templates, videos, audio, and AI-assisted materials, is the intellectual property of the Company or its licensors.
You are granted a limited, non-transferable, non-exclusive license to use the materials for your personal or internal business use only.
You may not copy, reproduce, distribute, modify, sell, sublicense, or create derivative works without prior written permission.
AI-generated outputs created within the Program may not be resold, packaged, or used to train other AI systems.
12. Independent Contractor Relationship
Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and the Company.
The Company acts as an independent contractor at all times.
13. Warranties and Disclaimers
The Services are provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, the Company disclaims all warranties, express or implied.
14. Limitation of Liability
To the maximum extent permitted by law:

The Company is not liable for indirect, incidental, special, or consequential damages

Total liability is limited to the amount paid by you for the Services
The Company is not responsible for decisions made based on AI-generated content or third-party platforms.
15. Non-Disparagement
You agree not to make false, defamatory, or disparaging statements about the Company, its services, or participants.
16. Changes to Terms
The Company may update these Terms at any time. Updated Terms will be posted on the Site and are effective upon posting.
Continued use of the Services constitutes acceptance of the updated Terms.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Victoria, Australia.
The parties agree to attempt to resolve disputes in good faith through negotiation before pursuing legal action.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
19. Entire Agreement
These Terms constitute the entire agreement between you and the Company and supersede all prior agreements or understandings.
